Before Notary Appointment

The State of Florida has specific laws that notaries must follow. It is imperative the following have been satisfied, in order for the notarization to be completed:

  • The form must be completely filled out,

  • The form must have a notary certificate.

  • All signers must be present at the appointment,

  • All signers must produce an original, unexpired photo ID

  • The signer must be of sound mind, alert, and mentally competent.

  • The signer must want to sign the document being notarized.

PLEASE READ VERY CAREFULLY
ACCEPTABLE NOTARY IDENTIFICATION

Driver's License

  • Issued by the Florida Department of Highway Safety and Motor Vehicles.

  • Issued by a territory of the United States, another state, Canada or Mexico.

Identification Card

  • Issued by the Florida Department of Highway Safety and Motor Vehicles.

  • Issued by a territory of the United States or another state other than Florida.

  • Issued by any branch of the U.S. Armed Forces (DD form 2).

  • Veteran Health Identification card issued by U.S. Department of Veterans Affairs

  • Issued by the U.S. Department of Justice, U.S. Bureau of Citizenship and Immigration Services, "Resident Alien", form I- 551.

Passport

  • Issued by the U.S. Department of State.

  • Issued by a foreign government, if stamped by the U.S. Department of Justice, Immigration and Naturalization Service.

Inmate Card

  • Issued on or after 1/1/1991 by the FL Department of Corrections for an inmate who is currently in custody of the department. (No signature on card)

  • Issued by the U.S. Department of Justice, Bureau of Prisons for an inmate who is in custody of the department.

  • A sworn, written statement of a Law Enforcement Officer that the forms of identification for an inmate in an institution of confinement were confiscated upon confinement, and that the person named in the document is the person whose signature is to be notarized.

If the signer is unable to produce an acceptable identification document, the signer may provide one (1) of the following:

  • Sworn written statement of a creditable witness who is personally known to the notary and who personally knows the signer, OR

  • Sworn written statement of two (2) creditable witnesses whose identities are proven to the notary and who personally know the signer and

  1. The person whose signature is to be notarized is the person named in the document.

  2. The person whose signature is to be notarized is personally known to the witness;

  3. That it is the reasonable belief of the witness that the circumstances of the person whose signature is to be notarized are such that it would be very difficult or impossible for that person to obtain another form of identification;

  4. The person whose signature is to be notarized does not posses any of the identification documents specified; herein, and

  5. The witness do not have a financial interest in nor are parties to the underlying transaction.
